Terms of Service
Please read these Terms of Service carefully before using our website or renting a vehicle from 1013 Auto Sales and Rental. By accessing our website or signing a rental agreement, you agree to be bound by these terms.
1. Agreement to Terms
By using this website or entering into a vehicle rental agreement with 1013 Auto Sales and Rental, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use our services.
2. Eligibility Requirements
To rent a vehicle, you must:
- Be at least 21 years of age
- Hold a valid U.S. driver's license
- Have an acceptable driving history (as determined by our background check)
- Have an active or pending account on at least one gig platform
- Provide all required documentation upon request
3. Rental Agreement
A separate vehicle-specific rental agreement will be signed at the time of vehicle pickup. The rental agreement governs the specific terms of your rental period, vehicle condition, security deposit, and permitted use. In the event of conflict between these Terms and the rental agreement, the rental agreement shall control for vehicle-specific matters.
4. Payment Terms
- Payments are due at the start of each rental period (weekly, bi-weekly, or monthly)
- A refundable security deposit is required at vehicle pickup
- Late payments may incur fees as specified in your rental agreement
- We accept cash, Zelle, and approved payment cards
- Returned checks or failed payments may result in immediate vehicle return
5. Vehicle Use
You agree to use the vehicle only for:
- Transportation network company (TNC) driving and delivery gig work
- Personal transportation incidental to gig work
You agree NOT to:
- Allow any unauthorized driver to operate the vehicle
- Use the vehicle for towing, racing, or off-road driving
- Transport hazardous materials
- Use the vehicle in violation of any applicable law
- Remove the vehicle from the state of California without written permission
6. Insurance
Commercial auto insurance is included in your rental. Coverage applies during active gig platform trips and personal use. You are responsible for reporting any accidents or incidents to us immediately and cooperating with all insurance investigations.
7. Damage and Liability
You are responsible for any damage to the vehicle caused during your rental period that exceeds normal wear and tear. A vehicle inspection will be conducted at pickup and return. Damage beyond the security deposit amount may be billed to the renter.
8. Termination
Either party may terminate the rental with 48 hours notice at the end of any rental period. 1013 Auto reserves the right to immediately terminate a rental and require vehicle return for: non-payment, use policy violations, suspension of gig platform account, or any activity that puts the vehicle or public at risk.
9. Dispute Resolution
Any disputes arising from these terms or your rental agreement shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Santa Clara County, California, under the rules of the American Arbitration Association. Disputes must be filed individually — class action waiver applies.
